What a Divorce Lawyer in Franklin Lakes, NJ Actually Does for You

When Franklin Lakes residents think about hiring a divorce attorney, they often focus on the paperwork — but that is only the beginning. Legal representation from Konzelmann Law means having a knowledgeable advocate at your side through every stage of the process. From the moment you retain a divorce lawyer with our firm, you gain someone who handles the legal complexities so you can focus on your family, your work, and your wellbeing. Our scope of representation for Franklin Lakes clients may cover a wide range of family law matters, including:

  • Equitable distribution of marital property, assets, and debts accumulated during the marriage
  • Child custody arrangements and parenting time schedules built to protect your relationship with your children
  • Child support calculations and negotiations aligned with New Jersey guidelines
  • Alimony and spousal maintenance determinations based on your financial circumstances
  • Mediation and alternative dispute resolution for couples seeking a less adversarial path
  • Courtroom advocacy and litigation representation when contested matters require it

No two divorces in Franklin Lakes are alike. A couple with a long-established home in the Stonegate or Franklin Crossing neighborhoods faces a different set of legal issues than a younger couple with fewer accumulated assets. That is exactly why our process starts not with strategy but with listening — understanding your specific family dynamics, your financial picture, and what matters most to you before we ever map out a plan of action.

Why the Right Divorce Attorney Is the Most Important Decision You'll Make

Divorce touches every corner of your life. For Franklin Lakes residents, that can mean figuring out what happens to a family home that has been in the neighborhood for years, restructuring finances that supported a high standard of living, and finding a new rhythm with your children after years of shared routines. The emotional weight of all of this can make clear thinking feel impossible — and yet clear thinking is exactly what the legal process requires. A skilled divorce lawyer serves as both a strategic advisor and a stabilizing presence, helping you make decisions grounded in fact and foresight rather than fear or frustration. In Franklin Lakes, where property values are substantial and family ties run deep, having the right legal representation from the start is not a luxury — it is essential.

Some Franklin Lakes divorces resolve smoothly when both spouses are willing to work together. Others surface significant conflicts — over the family home, retirement accounts, business interests, or custody of children. Knowing whether your situation calls for a cooperative approach or courtroom advocacy is something your divorce attorney helps you assess early. The right strategy depends entirely on the facts of your case, and a misstep in either direction — being too aggressive when cooperation would serve you, or too passive when the stakes demand advocacy — can cost you in ways that are difficult to recover from.

New Jersey family law is nuanced, and understanding how it applies to your specific circumstances in Franklin Lakes is the foundation of a successful outcome. When you work with a divorce attorney who truly knows the law at a granular level — equitable distribution standards, alimony factors, custody criteria under New Jersey courts — you leave the process with more than a signed decree. You leave knowing your rights were defended and your future considered at every turn.

What Makes Konzelmann Law a Recognized Divorce Law Firm in Franklin Lakes, New Jersey

Konzelmann Law's approach to serving Franklin Lakes clients is shaped by values that put people ahead of process. In a borough where community reputation and long-term relationships matter, we believe the way we handle your case is just as important as the result we achieve.

Personal Attention From Start to Finish. Franklin Lakes clients are never passed off to a junior staff member and left wondering what is happening with their case. Attorney Danielle Konzelmann is recognized among New Jersey's most sought-after family law and divorce attorneys, and she brings that level of focus and care to every client relationship — learning the details of your family, your priorities, and your concerns rather than treating your case as a file number.

Solution-Oriented Strategy. Before we discuss tactics, we discuss goals. What does a successful resolution look like for you and your children? What are your financial priorities going forward? Once we understand your definition of a good outcome, we design a legal strategy tailored to reaching it — whether that unfolds through negotiation or in front of a judge.

Experience Across Complex Case Types. Our firm has handled hundreds of divorce and family law matters across New Jersey, including cases with significant asset portfolios, business ownership questions, and high-conflict custody disputes. Franklin Lakes clients bring complex circumstances — and we have the experience to match them.

Personal Attention From Start to Finish. For Franklin Lakes families, the stakes in a divorce are personal — not just financial. When you contact Konzelmann Law, you are treated as a person with a real story, not as a case type. Attorney Danielle Konzelmann takes the time to understand what you are facing, what your children need, and what your goals are before any legal strategy is discussed. She is recognized as one of New Jersey's most trusted family law attorneys, and her clients in Bergen County consistently describe her representation as both thorough and genuinely caring.

Solution-Oriented Strategy. Winning in divorce does not always mean fighting the hardest — it means pursuing the outcome that actually serves your long-term interests. For Franklin Lakes clients, that might mean negotiating a settlement that protects the family home, securing a custody arrangement that keeps the children in their school district, or structuring support terms that allow both parties to move forward sustainably. We identify your priorities at the outset and build every legal decision around reaching those goals efficiently and effectively.

Experience Across Complex Case Types. The legal landscape in Franklin Lakes divorces can be complicated — homes with significant equity, dual-income households, retirement accounts built over decades, and occasionally business or investment interests. Konzelmann Law has handled hundreds of divorce and family law cases across New Jersey, including high-asset contested matters and delicate custody disputes. We bring that depth of experience to every case we accept, regardless of where it falls on the complexity spectrum.

Contested vs. Uncontested Divorce — Which Path Is Right for You?

One of the foundational decisions in any Franklin Lakes divorce case is whether it is likely to proceed as contested or uncontested. That determination shapes everything — how long the process takes, what it costs, and how aggressively your divorce lawyer needs to advocate on your behalf.

When both spouses broadly agree on how to divide property, manage custody, and structure support, an uncontested divorce may be within reach. These cases tend to move more efficiently and require less litigation — but they still benefit from careful legal review so that nothing important is overlooked or surrendered without your full understanding.

Contested divorces arise when meaningful disagreements exist — over the house, retirement funds, the children's living situation, or ongoing support. In Bergen County Superior Court, these matters can become complex and drawn out without skilled legal guidance. A capable divorce attorney is not optional in contested proceedings; the legal process simply demands it.

Konzelmann Law also provides divorce mediation services for Franklin Lakes couples who want to resolve their differences in a structured but less adversarial setting. Mediation preserves more control for both parties and can significantly reduce both cost and conflict while still producing a binding, comprehensive agreement.

When both spouses in a Franklin Lakes divorce are aligned on the core issues — how the home will be handled, how custody will be structured, how finances will be divided — an uncontested process may move relatively quickly. Still, even cooperative divorces benefit from independent legal review. Without a divorce lawyer examining the proposed terms, it is easy to unknowingly give up rights to retirement accounts, equity, or future support. Our role in uncontested matters is to make sure the agreement you sign is one you can live with for years to come.

When Franklin Lakes spouses cannot reach agreement on one or more significant issues, the divorce becomes contested — and the legal demands increase substantially. Discovery, motions, court appearances, and in some cases trial become part of the picture. In Bergen County courts, contested divorce proceedings require an attorney who knows the procedural landscape, understands how local judges approach contested matters, and can advocate assertively without losing sight of your ultimate goals. Konzelmann Law brings exactly that kind of seasoned courtroom presence.

Konzelmann Law also provides divorce mediation as a service for Franklin Lakes couples who want a path through their divorce that minimizes court involvement. A neutral mediator helps both parties work through disagreements on property, custody, and support in a structured environment. For couples in Franklin Lakes who share community ties, mutual friends, or co-parenting responsibilities, mediation can preserve a degree of civility that adversarial litigation often erodes — and it typically costs significantly less while still resulting in a legally enforceable agreement.

Equitable Distribution: How Property Is Divided in a New Jersey Divorce

New Jersey does not divide marital property down the middle the way community property states do. Instead, the law calls for equitable distribution — meaning the court divides marital assets and debts in a way that is fair given the totality of the circumstances. For Franklin Lakes residents, where marital estates often include high-value real property, retirement accounts, and investment holdings, understanding how equitable distribution actually works is critical before any negotiation begins.

Courts weigh factors like the length of the marriage, each spouse's financial and non-financial contributions, current and future earning potential, and the standard of living the family maintained. Without a divorce lawyer who knows how Bergen County courts approach these cases, you risk settling for terms that undervalue what you contributed. Our attorneys work to ensure the full picture of your marriage is presented — and that your financial future is protected in the process.

Equitable distribution is where many Franklin Lakes divorces get most complicated — and most consequential. A family home with years of appreciated value, a pension earned over a decades-long career, or a jointly managed investment account all require careful legal analysis before any division is agreed upon. A divorce lawyer who understands how New Jersey courts evaluate these assets, and who knows how to document and argue your contributions, can mean the difference between a settlement that sets you up for the future and one that leaves you financially disadvantaged. Konzelmann Law ensures that the division of your marital estate reflects reality — not just what your spouse or their attorney proposes.

How Much Does a Divorce Lawyer Cost in Franklin Lakes, NJ?

The cost of divorce legal representation in Franklin Lakes varies based on several factors specific to your situation. Uncontested cases where both parties are cooperative and aligned on major terms tend to cost less and resolve more quickly than contested matters requiring discovery, hearings, and potentially trial. Cases that involve disputes over real estate, significant retirement accounts, business interests, alimony, or custody arrangements naturally require more legal work and carry higher overall costs. Most New Jersey divorce attorneys bill hourly, though some simpler cases may be handled on a flat-fee basis. The most important thing Franklin Lakes residents can do is schedule a consultation early — before making decisions that could affect their legal position. At Konzelmann Law, we approach fee discussions with full transparency. When you call our office, we will explain what representation in your specific situation is likely to involve so you can plan accordingly. There are no surprises with our firm.

What Is a Wife Entitled to in a Divorce in Franklin Lakes, NJ?

New Jersey law gives both spouses — regardless of gender or role during the marriage — meaningful legal rights in a divorce proceeding. Franklin Lakes residents should understand that these rights do not automatically appear on paper; they must be identified, asserted, and protected. Whether you were the primary breadwinner or the primary caregiver, your contributions to the marriage matter under New Jersey law and can influence outcomes on property division, alimony, custody, and parenting time. Spousal support may be available to either spouse depending on financial circumstances and the length of the marriage. When children are involved, custody and support decisions are made using a best-interests standard that considers stability, parental involvement, and the children's established routines — which, in a community like Franklin Lakes with strong school ties and neighborhood networks, can carry real weight in proceedings. A knowledgeable divorce attorney helps you understand exactly what you are entitled to and builds the case to support it.

What Are the 3 C's of Divorce?

The 3 C's of divorce — communication, compromise, and cooperation — reflect principles that can shape how constructively a Franklin Lakes divorce unfolds. Communication, often channeled through attorneys or a mediator rather than directly between spouses, keeps the process from derailing into avoidable conflict. Compromise acknowledges that divorce rarely gives either party everything they want, and that a sustainable resolution usually requires each side to show some flexibility. Cooperation — especially when children are sharing time between two households in the same community — means making decisions that serve the family's long-term wellbeing rather than prolonging a dispute out of frustration. For Franklin Lakes families with children in local schools, shared neighborhood connections, and ongoing co-parenting ahead of them, these principles are not abstract ideals — they are practical tools. Konzelmann Law helps clients embrace these values while still advocating firmly for their legal rights when the situation calls for it.

What Is the First Thing I Should Do If I Want a Divorce?

If you are considering divorce in Franklin Lakes, the most protective step you can take right now is to speak with an experienced divorce lawyer before doing anything else — before leaving the marital home, before making financial moves, before discussing terms with your spouse. Actions taken early in a divorce often have lasting legal consequences, and understanding your rights under New Jersey law before you act is essential. Your attorney will help you understand what the process looks like, what factors are likely to influence your case, and what you should be doing — and not doing — from this moment forward. You should also begin gathering key financial documents: tax returns, mortgage statements, bank and investment account records, retirement account summaries, and documentation of any debts. This information will form the foundation of your case. If you are ready to take that first step, contact Konzelmann Law at (201) 771-6868 to schedule a consultation and begin protecting your future.

Frequently Asked Questions About Hiring a Divorce Lawyer in Franklin Lakes, NJ

  • How long does a divorce take in New Jersey?

    The timeline for a divorce in New Jersey depends on whether the case is contested or uncontested and the complexity of the issues involved. An uncontested divorce where both parties agree on all terms can be finalized in a matter of months once the mandatory waiting period and court scheduling are accounted for. Contested divorces, on the other hand, can take considerably longer — sometimes a year or more — especially when disputes over custody, equitable distribution, or alimony require extended negotiation or trial. Working with a divorce attorney who is experienced in New Jersey family law can help keep your case moving efficiently by anticipating obstacles, preparing thorough documentation, and pursuing resolution at every opportunity.

  • Do I need a divorce lawyer if my spouse and I agree on everything?

    Even when both spouses agree on the terms of their divorce, having a divorce attorney review the agreement is strongly recommended. What appears to be a straightforward arrangement can contain provisions that inadvertently waive important rights or create problems down the road. An experienced divorce lawyer will ensure that the agreement is comprehensive, legally sound, and that your interests are fully represented before you sign anything that becomes a binding court order. At Konzelmann Law, we regularly help clients with uncontested divorces who simply want the peace of mind that comes with professional legal review.

  • Can I modify a divorce agreement after it is finalized?

    In New Jersey, certain provisions of a divorce agreement can be modified after finalization if there has been a significant change in circumstances. Child support and custody arrangements are the most commonly modified terms, as changes in income, relocation, or a child's evolving needs may warrant an update to the original order. Alimony may also be subject to modification under specific conditions. Property division, however, is generally final once the judgment is entered. If you believe your circumstances have changed enough to justify a modification, consulting with a divorce lawyer is the best way to evaluate your options and understand the legal standard the court will apply.

  • What is the difference between divorce mediation and going to court?

    Divorce mediation is an alternative dispute resolution process where both spouses work with a neutral mediator to negotiate the terms of their divorce outside of the courtroom. Mediation is typically faster, less expensive, and less adversarial than traditional litigation, making it a strong option for couples who are able to communicate and are open to compromise. Going to court, on the other hand, involves each spouse retaining their own divorce attorney and presenting their case before a judge who makes the final decisions. Litigation may be necessary when there are significant disagreements that cannot be resolved through negotiation. Konzelmann Law offers both divorce mediation and courtroom representation, allowing our team to recommend the approach that best fits your situation and goals.

  • How do I choose the right divorce lawyer for my case?

    Choosing the right divorce attorney starts with finding someone who has focused experience in New Jersey family law and a track record of handling cases similar to yours. Beyond credentials, the right lawyer should make you feel heard, explain the legal process clearly, and offer a strategic approach tailored to your goals rather than a one-size-fits-all solution. Pay attention to how responsive the firm is during your initial contact — the way a firm treats you before you retain them often reflects how they will treat you throughout your case. At Konzelmann Law, we prioritize personal attention and solution-oriented representation because we believe every client deserves a divorce attorney who is fully invested in their outcome.

  • Who Can File For Divorce in NJ?

    Either the husband or the wife can file for divorce.  Grounds for divorce are no longer necessary to obtain a divorce in New Jersey.  Either party can allege that there has been an irretrievable breakdown in the marriage.  A divorce may be filed in New Jersey as long as the parties have been living in New York for at least one year.

  • How Does an Uncontested Divorce Work?

     An uncontested divorce just means that all of the  issues (including equitable division of all assets, child custody, child support, and alimony) have been decided and all that needs to be done is file the appropriate paperwork to obtain a judgment of divorce.  In most cases, before filing the uncontested papers, you should also have a legally binding Marital Settlement Agreement drafted and signed.

  • How is child support decided in New Jersey?

    Child support is generally determined by Child Support Guidelines and N.J.S.A. 2A:34-23 which requires the Court to consider a number of different factors:

    (1) Needs of the child;

    (2) Standard of living and economic circumstances of each parent;

    (3) All sources of income and assets of each parent;

    (4) Earning ability of each parent, including educational background, training, employment skills, work experience, custodial responsibility for children including the cost of providing child care and the length of time and cost of each parent to obtain training or experience for appropriate employment;

    (5) Need and capacity of the child for education, including higher education;

    (6) Age and health of the child and each parent;

    (7) Income, assets and earning ability of the child;

    (8) Responsibility of the parents for the court-ordered support of others;

    (9) Reasonable debts and liabilities of each child and parent; and

    (10) Any other factors the court may deem relevant.

  • What is permanent spousal alimony or support?

    There is NO legally mandated formula for calculating spousal alimony.  Generally speaking, the formula works such that the greater the difference between the parties’ income, the greater the amount of support that will be mandated.  The formula is gender neutral, so if the wife earns more than the husband, she may, in fact, be ordered to pay support to the husband.  There are fourteen (14) mandatory factors, however, which allow the judge to deviate, awarding an amount different than the formula would otherwise require.

  • How is property divided in a New Jersey Divorce?

    New Jersey is an “equitable distribution” state, meaning the judge has the discretion to divide the parties’ property fairly, not necessarily equally.  Most marital property, however, is divided equally in most situations.  The main exceptions are premarital property and inherited property that has been kept separate.

  • What am I entitled to in a divorce in NJ?

    You are entitled to a fair (not necessarily equal) division of the marital property; reasonable time with the children, whether as the custodial parent or non-custodial parent; child support for the custodial parent; and potentially alimony for the lower-earning spouse. The most important point, however, is that there is more than one way to decide a case, so having the right representation is crucial.

  • What does a prenuptial agreement cover?

     A prenuptial agreement can cover more or less ground, depending on your needs.  The simplest prenuptial agreements just address one issue, such as keeping a premarital business separate in the event of a divorce.  But the prenuptial can cover how the bills will get paid, whether or not separate accounts will be kept, or what to do if the parties purchase real estate or make investments.

    A prenuptial agreement cannot cover child support and custody.

  • What happens if you don't pay child support in New Jersey?

    Child support can be enforced several different ways.  The payor's salary can be garnished to pay support as well as accumulated arrears (back-due support).  A court can enter a money judgment which can be enforced against a bank account or other assets in the payor's name.  A court can suspend the payor's driver's license or other professional license or certification.  Finally, under certain circumstances, a court can find the payor in contempt and sentence the payor to jail unless he pays a certain amount by a set date.
